Terms of Service

1. Who we are

Buy Low Sell High Club ("the Club", "we", "us") is a service of Data Whisperer LLC, a Kansas limited liability company based in Kansas City, Kansas. These terms are the agreement between you and Data Whisperer LLC. By making an account or paying for a plan, you agree to them.

2. What the service is

The Club is an online research tool for people who buy at auction to resell. For lots at covered auctions, and for items you look up by photo or barcode, we show recent sold prices, an estimate of fees, tax and shipping, a rating, and a suggested maximum bid.

We do not run auctions, place bids, sell goods, or hold money for you. Bidding, paying and picking up happen between you and the auction house, under the auction house's own terms.

3. No promise of profit

Everything we show is information, not advice. Sold prices are past sales and do not promise what your item will sell for. Ratings and max bids come from formulas and from data that can be thin, late or wrong. Photos and descriptions come from the auction house and we do not inspect any item.

You are responsible for every bid you place and every item you buy. Check the item, the auction's fees and the pickup terms yourself before you bid.

4. Your account

• You must be at least 18 and able to enter a contract.
• Give us a working email address and keep your sign-in details to yourself.
• An account is for one person. Sharing a sign-in is not allowed. If the pattern of devices and locations on an account shows it is being shared, we may ask you to confirm it is you, limit the account, or close it.
• You are responsible for what happens under your account.

5. Plans, billing and renewal

• First Auction Pass. A one-time payment. It unlocks one live auction of your choice until that auction closes, plus a set number of lookups. It does not renew. One pass per person.
• Monthly plans (Starter and Club). Billed in advance each month to the payment method you gave at checkout. They renew automatically every month until you cancel. Each plan includes a set number of auctions and lookups per billing month. Unused auctions and lookups do not carry over.
• Lookup top-ups. A one-time purchase of extra lookups. Top-up lookups do not expire while your account is open.

Prices are in US dollars and are shown before you pay. Any sales tax that applies is added at checkout. Payments are handled by Stripe. We never see or store your full card number.

If we change the price of a monthly plan, we will email you at least 14 days before the new price applies to you. If you do not want the new price, cancel before your next renewal.

If a renewal payment fails, we may try the card again and may pause paid features until payment goes through.

6. Cancelling and refunds

You can cancel a monthly plan any time from your account. You keep what you paid for until the end of the current billing month, and you are not charged again. The details, including when we give money back, are in our Refunds and cancelling page, which is part of these terms.

7. Fair use

You may use the Club for your own buying and reselling. You may not:

• Scrape, bulk download or copy the data, or use a script or bot to read it.
• Resell, republish or share our prices, ratings or max bids with people who are not members, or use them to build a competing product.
• Try to get around plan limits, account limits or security.
• Upload anything illegal, anything you have no right to share, or anything meant to harm the service or other members.
• Use the service to break an auction house's rules or the law.

We use rate limits to keep the service fair and to control what the data costs us. Normal use by one person will not hit them.

8. What you send us

Photos you upload for a lookup, feedback, and reports of what you bought and sold stay yours. You give us permission to use them to run the service and to make our prices and ratings more accurate. We only show something you sent us to the public, such as a win you chose to share, if you say yes to that first. You can take that yes back at any time.

9. Our content and other companies' names

The site, its design, our ratings, formulas and compiled data belong to Data Whisperer LLC. We give you a personal, non-transferable right to use them while your account is in good standing.

eBay, HiBid and Equip-Bid are trademarks of their owners. We are not affiliated with, endorsed by or sponsored by any of them, or by any auction house.

10. The service may change or go down

We work to keep the Club running and accurate, but we provide it "as is" and "as available". We do not promise it will always be up, that every auction or lot will be covered, or that every lot can be priced. We may add, change or remove features and covered auctions. If we remove something that materially cuts what a paid plan gives you, you can cancel and ask for a refund of the unused part of that month.

11. Limits on what we owe you

To the fullest extent the law allows, Data Whisperer LLC is not liable for lost profits, a bad buy, a missed auction, or any indirect or consequential loss that comes from using the service or relying on what it shows. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is more.

Nothing in these terms takes away rights the law says cannot be waived.

12. Ending an account

You can close your account at any time. We may suspend or close an account that breaks these terms, is used for fraud, or puts the service or other members at risk. If we close an account for a reason other than a breach of these terms, we refund the unused part of the current paid month.

13. Changes to these terms

We may update these terms. If a change matters to you, we will email you or post a notice on the site at least 14 days before it takes effect. Using the Club after that date means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of Kansas. Any dispute that we cannot settle directly will be heard in the state or federal courts serving Wyandotte County, Kansas. Please write to us first. Most problems can be fixed with one email.
